Terms & Conditions Policy – Seventy percent Kitchen

Introduction


 The SEVENTY PERCENT KITCHEN Platform (www.70percentqa.com) welcomes you and sets out below the terms and conditions governing the SEVENTY PERCENT KITCHEN Platform.

In the application of the following terms and conditions, the following words shall have the meanings assigned thereto unless the context otherwise requires:

- SEVENTY PERCENT: Platform, Website and/or Application.

- Services: All services offered and provided by the website.

- User and/or Customer: Any natural person or legal entity whether it displays, uses, accesses, browses or sends any content to the website. 

Acceptance and Confirmation of Terms and Conditions:

Please read the terms and conditions of use of the website carefully before you start using the services available offered thereto. If the user does not agree to these terms and conditions, they must uninstall the website. 

By accessing, using, browsing or subscribing on the Website, the User agrees to the terms and conditions of use thereof as a binding legal agreement between the user and the Website without any reservations or conditions. The consent shall include the terms of use and other policies represented by the cancellation and refund policy, the privacy policy and other policies and/or conditions that are published regularly on the Website and is effective from the date of installing the Website on the User's device.

Clause (1): Eligibility and Use


 A. Subscription is available for all age groups.

B.  For customers under 18, parents or legal guardian must confirm meal selection. 

C. The Customer shall use the Website only for legitimate purposes and must refrain from any use contrary to the laws or harmful to the reputation of SEVENTY PERCENT KITCHEN or its customers. Any misuse may lead to suspension or cancellation of the account.

Clause (2): Account Creation and Liability


 A. Correct and complete information must be provided upon registration.

B. The user is fully responsible for the confidentiality of their account data and password, and for any activities carried out through the account.

C. It is prohibited to use another person's account or allow others to use the account without explicit permission. 

Clause (3): Communication and Correspondence


A. By registering, you agree to receive communications from SEVENTY PERCENT KITCHEN via email, text messages, or app notifications.

B. You can unsubscribe from promotional and marketing messages at any time through your account settings or via the unsubscribe link embedded in the messages.

Clause (4): Amendment to the Terms and Conditions


A. SEVENTY PERCENT KITCHEN shall have the right to amend this Terms and Conditions Policy at any time without prior notice, and the User shall be responsible for reviewing the Subscription Terms and other Website Policies and Conditions and shall notice/ follow up the relevant amendments.

B. Each visit by the user to the website is subject to the current subscription terms, and the continued use of the website and its other current policies and amended subscription terms confirms that the user has read and agreed to be bound by such amendments.

Clause (5): Payment and Subscriptions


Please read the following terms and conditions carefully before subscribing. Payment is only processed after you agree to all the terms and conditions listed below. By completing the subscription, you confirm that you have read, understood, and fully accepted these Terms & Conditions.

1) Delivery Start

Delivery will start one (1) day after menu selection and payment confirmation.

2) Delivery Time Window

Delivery is available from morning until evening. A specific delivery time cannot be selected, as delivery times vary by area.

3) Consumption Policy

The box is intended to be consumed the following day, not on the same day it is delivered.

4) Modifications, Area Change, Freeze, and Cancellation Requests

If you have any comments, wish to modify meals, change the delivery area, freeze, or cancel your subscription, you must notify us at least two (2) business days in advance.

  • If the subscription is frozen within two (2) business days, the box fee will be charged.

5) Payment and Subscriptions

A. Payment must be completed before the subscription becomes valid.

B. Unpaid subscriptions are automatically canceled.

C. All fees shall be paid in Qatari Riyals (QAR) through the payment methods approved on the website/app.

D. Prices are subject to change without prior notice; however, prices confirmed in paid orders remain valid.

6) Freeze Limit

Subscriptions can be frozen for one (1) month only, after which the subscription will be automatically canceled by the system.

7) Same-Day Cancellation

Cancellation on the same day as delivery will be charged at the box fee.

8) Delivery Days

Delivery is available daily from Saturday to ThursdayNo delivery on Friday.

9) Number of Boxes

  • Weekly plan: 6 boxes per week
  • Monthly plan: 26 boxes per month

Clause (6): Privacy and Data Protection Policy


A. SEVENTY PERCENT KITCHEN  is committed to protecting and using your personal data only for purposes related to subscription management, service delivery and meal delivery.

Clause (7): Complaints, Shipping and Returns Policy


- Complaints:

A. SEVENTY PERCENT KITCHEN complies with all provisions of the Consumer Protection Law No. (8) of 2008.

B. The customer must submit any complaint within 48 hours of receiving the order in case of a damaged or incorrect product.

C. Meals cannot be returned or exchanged after they have been delivered, for health and food safety reasons.

- Shipping and Returns:

A. If the fault is from SEVENTY PERCENT, shipping and return costs shall be borne by us.

B. If the fault is from the customer (e.g. incorrect address or absence on delivery), the costs incurred shall be borne by the customer.

C. SEVENTY PERCENT KITCHEN is not responsible for delays or issues that goes beyond its control.

Clause (8): Cancellation and Refund Policy


A. The customer can request to cancel the subscription at least 48 hours before the start of the subscription, i.e. two days before the scheduled start date, so that SEVENTY PERCENT KITCHEN can stop preparing meals.

B. If the cancellation request is submitted after this period (48 hours), the subscription cannot be refunded or canceled since SEVENTY PERCENT KITCHEN has already started the preparation and supply of meals.

C. In order to maintain food health and safety, it is prohibited to return or exchange meals after they have been delivered to the customer, in order to ensure the quality and safety of food products.

D. In the event of an error on the part of SEVENTY PERCENT, such as delivery of a non-conforming meal or a damaged product, the customer has the right to request a replacement of the meal or a refund, after the case is verified by the customer service team.

E. Any amounts due for refund, if any, shall be processed within 5-10 business days from the date of approval of the application, and in the same manner as payment was made unless otherwise agreed.

Clause (9): Limitation of Liability


A. The Services “as is” without any warranties of any kind, express or implied.

B. SEVENTY PERCENT KITCHEN accepts no responsibility for any health complications or dietary outcomes arising from conditions or allergies not previously disclosed by the Customer.

C. In all cases, the liability of SEVENTY PERCENT KITCHEN is limited to the value of the subscription.

D. SEVENTY PERCENT KITCHEN is not responsible for delays or issues beyond its control.

Clause (10): Suspension or Termination of Account


SEVENTY PERCENT KITCHEN may, at its sole discretion, suspend or cancel the account or subscription in the event of violation of any of these conditions, without any obligation to refund the amounts paid.

Clause (11): Intellectual Property Rights


A.  The SEVENTY PERCENT KITCHEN website and every right on the website are protected by intellectual property rights and trademark laws.

B.  All content of the website is the sole property of SEVENTY PERCENT, including (written and unwritten texts, designs and graphics, technical ideas, logos, offers, button icons, icons, audio clips, aggregated data and electronic programs), and no person has the right to use it in any way, whether directly, indirectly or through a third party.

C. SEVENTY PERCENT KITCHEN management shall have the right to take the necessary action against infringement and violations of any of the rights or intellectual property of the SEVENTY PERCENT KITCHEN website.

Clause (12): Compensation


User agrees to indemnify and defend SEVENTY PERCENT KITCHEN against any claims, losses, or damages resulting from misuse of the Service, violation of these Terms, or violation of applicable laws.

Clause (13): Notices and Transfer


SEVENTY PERCENT KITCHEN may transfer its rights or obligations under this Agreement to any other party without prior notice, and the User may not transfer its subscription or account to any other party without prior written consent.

Clause (14): General Provisions


A. If any provision of these terms is determined to be invalid or unenforceable, the remainder shall remain in full force and effect.

B. This agreement represents the full and final understanding between the User and SEVENTY PERCENT KITCHEN with respect to your use of the Service.

C. This agreement shall not be deemed to create any partnership, agency relationship, or mutual representation between the Customer and SEVENTY PERCENT.

Clause (15): The Governing Law and Disputes Resolution


A. These terms shall be governed by and construed in accordance with the laws of the State of Qatar.

B. In the event of a dispute, the dispute shall be resolved through amicable settlement within two weeks. If a resolution is not reached and the dispute continues, the Qatari courts shall have jurisdiction to settle the dispute.

Clause (16): Official text


in case of difference between the Arabic and English text, the Arabic text shall prevail.
